Terms & Conditions

Agreement

Gravida Atelier provides a curated inventory of clean, exclusive, and previously worn maternity gowns and accessories for rental (the “Gown”). Use of any rental services, Gowns, accessories or information offered by Gravida Atelier (the “Services”) is governed by these Terms and Conditions (the “Agreement”).

 

By using the Services, you (“you” or the “Renter”) confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you may not use the Services.

 

You further confirm that you are at least 18 years of age, or have the consent and approval of a parent or legal guardian.

Rental Terms

  • You acknowledge that you are renting the Gown, and that ownership remains with Gravida Atelier at all times.

  • Rental fees, deposits, delivery charges, and any other applicable costs will be displayed at checkout.

  • In the event of a manual payment, Gowns will only be released for shipment once the total payment reflects in the Gravida Atelier bank account.

 

Inspection on Delivery

  • It is your responsibility to inspect the Gown upon delivery.

  • Any quality concerns or incorrect deliveries must be reported within 2 hours of delivery, with photographs sent to yummybumpsza@gmail.com.

  • Failure to notify within this period will be deemed acceptance that the Gown was received in good order.

 

Responsibility for Care

  • You assume responsibility for the Gown once delivery has been confirmed.

  • You will be liable for any loss, theft, damage, staining, or destruction of the Gown during your rental period.

  • Excessive cleaning fee: R300 if organic debris is found.

  • Repairs: Minor damages will be charged at cost, determined by a tailor.

  • Mould prevention: Gowns used in water must be air-dried after use and prior to return.

 

Gravida Atelier may deduct such costs from your refundable deposit.

Rental Process

  • Standard rental period: 3 days.

  • Extensions: 30% of the rental fee per day.

  • Return: The Gown must be returned using the provided return label.

 

Refundable Deposit

  • A refundable deposit of 50% of the rental fee is payable at checkout.

  • Refunds will be processed within 48–72 hours of the Gown being returned in acceptable condition

Late Fees

  • Late return impacts future customers.

  • Late fees are 15% of the rental fee per day per item.

  • You remain liable for late fees even if a third party is responsible for the return.

Limitation of  Liability

Limitation of Liability (Consumer Protection Act (CPA) Aligned)

  • Gravida Atelier provides Services “as is” and makes no guarantees other than those required by law.

  • To the extent permitted by the CPA, Gravida Atelier’s liability is limited to the total amount paid by you for the rental.

  • Nothing in this Agreement limits your statutory rights under the CPA.

Indemnification

​You agree to indemnify and hold harmless Gravida Atelier, its owners, employees, and agents from claims or damages arising from your use of the Gown, except where caused by gross negligence or wilful misconduct by Gravida Atelier.​

Force Majeure

Gravida Atelier will not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including natural disasters, pandemics, strikes, or government actions.

Governing Law

This Agreement is governed by the laws of the Republic of South Africa, including the Consumer Protection Act, 2008. Any disputes shall fall within the jurisdiction of South African courts.
